BASIC PROVISIONS
1. The controller of personal data within the meaning of Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: “GDPR”) is Finstable s.r.o., with its registered office at Bohdalice 62, 683 41 Bohdalice-Pavlovice (hereinafter: “controller”).

3. Personal data means any information about an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
4. The controller has not appointed a data protection officer.

SOURCES AND CATEGORIES OF PROCESSED PERSONAL DATA
5. The controller processes personal data that you have provided in connection with participation in the film festival, registration, accreditation, volunteer activities, or any other form of involvement in festival activities.
6. The controller processes your identification and contact data and data necessary for the performance of the contract.
LEGAL BASIS AND PURPOSE OF PERSONAL DATA PROCESSING
7. The legal basis for processing personal data is:
- the performance of a contract between you and the controller pursuant to Article 6(1)(b) GDPR,
- the legitimate interest of the controller in providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR,
- your consent to the processing for the purpose of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in cases where no goods or services have been ordered.
8. The purpose of processing personal data is:
- ensuring participation in the film festival, processing registration, accreditation, or other forms of involvement, and the exercise of rights and obligations arising from these relationships; in these cases, the personal data required for their provision (e.g., name, address, contact) must be provided to enable participation,
- sending commercial communications and carrying out other marketing activities.
9. The controller engages in automated individual decision-making within the meaning of Article 22 GDPR. You have given your explicit consent to such processing.
DATA RETENTION PERIOD
10. The controller retains personal data:
- for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims arising from these contractual relationships (for a period of 15 years after termination of the contractual relationship),
- for the period until the consent to the processing of personal data for marketing purposes is withdrawn, for a maximum of 15 years, if the personal data is processed on the basis of consent.
11. After the retention period expires, the controller will delete the personal data.
RECIPIENTS OF PERSONAL DATA (PROCESSORS)
12. Recipients of personal data are persons:
- involved in the delivery of goods / services / execution of payments under a contract,
- involved in ensuring the operation of services,
- providing marketing services.
13. The controller intends to transfer personal data to a third country (non-EU country) or an international organisation. Recipients of personal data in third countries are providers of advertising, hosting, mailing, or cloud services.
YOUR RIGHTS
14. Under the conditions set out in the GDPR, you have the right to:
- access your personal data under Article 15 GDPR,
- rectify personal data under Article 16 GDPR, or restrict processing under Article 18 GDPR,
- erase personal data under Article 17 GDPR,
- object to processing under Article 21 GDPR, and
- data portability under Article 20 GDPR,
- withdraw consent to processing in writing or electronically to the address or email of the controller specified in Article III of these terms.
15. You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.
DATA SECURITY MEASURES
16. The controller declares that it has taken all appropriate technical and organisational measures to secure personal data.
17. The controller has taken technical measures to secure data storage and storage of personal data in paper form.
18. The controller declares that personal data is accessible only to persons authorised by the controller.
FINAL PROVISIONS
19. By submitting an application or registration via the online form, you confirm that you have read the Privacy Policy and that you accept it in full.
20. You agree to these terms by checking the relevant box during the application or registration process for the festival. By checking the consent box, you confirm that you have read the Privacy Policy and that you accept it in full.
The controller is entitled to change these terms. The new version of the Privacy Policy will be published on the controller’s website or sent to you by email to the address you provided to the controller.
These terms take effect on 10 June 2025.
